1. Definitions

In these terms, the following words have the meanings given:

• "Vestwell", "we", "us", "our" — the business operating from 64 Thanon Mittraphap, Nai Mueang, Mueang Khon Kaen, Khon Kaen 40000, Thailand
• "Client", "you", "your" — any person who uses our website or engages our services
• "Services" — Personal Filing System Setup, Retirement Readiness Seminars, and Records Digitisation & Filing as described on our website
• "Agreement" — these terms and any written service confirmation between us

2. Acceptance of Terms

By submitting a contact form, booking a service, or attending a seminar, you confirm that you are at least 18 years of age and have the legal capacity to enter into an agreement. If you are acting on behalf of another person, you confirm that you have their authority to do so.

3. Description of Services

Vestwell provides personal records organisation support and general educational information services. All services are described on our Solutions page at solutions.html. Services are available to individuals located in or able to travel to Khon Kaen Province, Thailand. We reserve the right to decline a service request if it falls outside our scope or capacity.

Important limitation: Vestwell does not provide financial planning, legal, tax, health, or investment advice. Nothing communicated by Vestwell — in writing, in seminars, or during service visits — constitutes professional advice of any regulated kind. Clients should seek appropriately qualified professionals for such needs.

4. Booking and Confirmation

Services are confirmed only when Vestwell provides written confirmation (by email or message). An enquiry or contact form submission does not constitute a booking. Pricing is confirmed in writing before any work begins. No additional charges will be applied without your prior agreement.

5. Pricing and Payment

• All prices are quoted and payable in Thai Baht (฿)
• Personal Filing System Setup: ฿3,700 per visit
• Retirement Readiness Seminar: ฿15,500 per person per session
• Records Digitisation & Filing: ฿31,500 per standard project
• Payment terms will be agreed in writing at the time of confirmation
• No travel charges apply within Mueang Khon Kaen district

6. Cancellation and Rescheduling

If you need to cancel or reschedule, please contact us as soon as possible. Cancellations made more than 48 hours before a scheduled appointment will not incur a charge. Cancellations within 48 hours may be subject to a partial administration fee, which will be communicated to you at the time of booking if applicable. Vestwell reserves the right to reschedule or cancel services in exceptional circumstances; we will provide as much notice as possible and arrange an alternative.

7. Document Handling

• All original documents you provide remain your property at all times
• Original documents are returned to you upon completion of the service — either on the day (Filing Setup) or within the agreed timeframe (Digitisation)
• Vestwell does not retain copies of personal documents without explicit written agreement
• Digital files created during a digitisation project are placed on storage you provide; no copies are held on Vestwell systems
• You are responsible for ensuring that any documents you provide to us do not contain information that you are prohibited from sharing

8. Intellectual Property

All content on the Vestwell website — including text, layout, and seminar materials — is the intellectual property of Vestwell. You may not reproduce, distribute, or use this content without our written permission. Resource booklets provided as part of seminar attendance are for your personal use only.

9. User Responsibilities

When using our services or website, you agree not to:

• Provide false or misleading information
• Use our services for any purpose that is unlawful or contrary to these terms
• Attempt to gain unauthorised access to any part of our systems
• Use our website in a way that could harm its functionality or reputation

10. Disclaimers

Vestwell's services are provided in good faith as general organisational and educational support. We make no representation that the use of our services will produce any particular financial, legal, or personal outcome. Information provided in seminars is general in nature and may not apply to every individual's circumstances. We recommend that you seek professional advice for matters specific to your situation.

The Vestwell website is provided "as is." We do not warrant that the site will be uninterrupted, error-free, or free from harmful components.

11. Limitation of Liability

To the extent permitted by Thai law, Vestwell's liability for any claim arising from use of our services is limited to the amount paid by you for the specific service to which the claim relates. We are not liable for indirect, consequential, or incidental losses. Nothing in these terms limits liability for fraud, gross negligence, or personal injury caused by our actions.

12. Termination

Either party may withdraw from a service engagement before it begins, subject to the cancellation terms in Section 6. Vestwell may decline to continue a service if circumstances arise that make delivery impossible or inappropriate, and will provide a proportionate refund for any undelivered portion.

13. Governing Law and Dispute Resolution

These terms are governed by the laws of Thailand. In the event of a dispute, we encourage informal resolution in the first instance — please contact us at [email protected]. If a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the competent courts in Khon Kaen Province.

14. General Provisions

• Entire agreement: These terms, together with any written service confirmation, constitute the entire agreement between us
• Severability: If any provision is found unenforceable, the remaining terms continue in full effect
• No waiver: Failure to enforce a provision does not constitute a waiver of it
• Assignment: You may not assign your rights under these terms without our written consent

15. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with the updated date. Continued use of our services after any update constitutes acceptance of the revised terms.
